Kiewa Country Cottages

Property and Cancellation Policies :

 CANCELLATION POLICY:

 

  • This Policy is applied to all bookings including direct phone bookings, email bookings and online bookings.
  • If your booking is cancelled within 14 days of your scheduled check-in time: a 100% cancellation fee will apply, and you will be required to pay to Kiewa Country Cottages the full amount of your booking fee less any amount which you have already paid. This fee will be charged to the guest's credit card. If insufficient funds are available; the debt will be passed onto a debt collecting company or the courts for the debt plus recovery costs.
  • If you do not show up for your booking or terminate your booking early after you have checked in, you will be charged a 100% cancellation fee and will be required to pay to Kiewa Country Cottages the full amount of your booking less any amount which you have already paid.
  • If your booking is cancelled outside of the 14 day cancellation period, you will receive a full refund of the deposit paid.
  • Cancellations or booking variations must be notified by email to info@kiewacountrycottages.com.au
  • If a booking variation is made (change of dates) inside the 14 day cancellation period, then full payment of the booking is required at the time of making the booking variation.
  • A variation of the booking which reduces the number of nights stay or guests will be a treated as a cancellation of the booking in respect of those nights. 


Terms and Conditions


Please read these terms and conditions carefully as these conditions incorporate the basis on which bookings for Kiewa Country Cottages are accepted.
It is your responsibility to have read and understood these Terms and Conditions before making a booking and paying a deposit.
A payment constitutes acceptance of these Terms and Conditions as follows:
 

The number of guests must not exceed the number stated on the booking confirmation notice. If you arrive with extra unbooked guests, extra person fees of a minimum $60 per night/per guest will apply, with a maximum of four guests permitted in the 2 bedroom cottage and 2 guests in the one bedroom apartment. Management reserves the right to refuse entry to excess numbers of unbooked guests. Persons found with extra unbooked/unpaid guests staying in their cottage, will have their stay revoked. No refund will be issued.

Check In

  • Check In starts at 3.00 pm and ends at approximately 9:00 pm.
  • Please come to Reception upon arrival or phone 0402 465 179 if Reception is unattended.
  • Photo identification (passport or Australian driver’s licence) and a valid credit card are required to check in. Valid photo identification (ID) matching the name of the main guest within the reservation must be presented at time of check-in. This is required in order to verify your identity for security purposes and to protect the credit cardholder. A valid Australian driver’s license, or an international passport are all acceptable forms of photo identification. This ID may be copied and securely stored as record that we have verified who you are and your authority to use your credit card as a combat to increasing credit card fraud. As per our privacy policy, any personal information contained on the collected identification will not be on-sold; will be securely stored and carefully disposed of at the end of its usefulness.
  • A $300 credit card pre-authorisation will be activated upon check in to cover any damages/excess cleaning/airing out etc, due to the cottage being left in an unacceptable state etc. This will be released on your day of departure, if no funds are required to be retained for excess cleaning or damage. The pre-authorised amount is set aside by the credit card company for a period of up to 30 working days (release times may vary, please check your product disclosure statement for terms and condition by your issuing financial institution).
  • The pre-authorisation will affect your available funds balance or spending limit. For more information on this practice we suggest the cardholder contact their issuer.
  • Once a pre-authorisation has been made, we cannot release, remove or lower the authorised amount, until we process the final account on departure. This is a restriction placed on us by the bank, and cannot be negotiated. Kiewa Country Cottages reserve the right to pre-authorise all credit cards upon arrival. Please note this process validates the presented credit card, and protects both the cardholder and merchant from increasing fraud incidents.


Check Out

  • Check Out time is no later than 10:00 am. Please bring the key to Reception and if Reception is unattended, leave the key in the white Key Drop Box to the right of the Reception door.
  • Please leave the property clean and tidy or you will be charged an excess cleaning fee. Please thoroughly:
  • Wash, dry and put away your dishes.
  • Place rubbish and recycling in the outside bins provided at the rear of the cottage door.
  • Please close the doors and windows, switch off electric blankets, the heating/cooling unit and the lights when you depart.


Other Policies:
For the comfort and safety of all guests please note:

  • Bookings may be transferred to another guest with prior written approval from management.
  • Children aged 2 years and older are charged at adult prices.
  • Rates are subject to change without notice.
  • You must provide a valid credit card when you check-in.
  • All guests must provide matching photo I.D as the credit card presented, and the card holder must sign the Arrival Registration Form.
  • No pets are allowed: Animals and pets are not permitted on or in the premises, in breach of this condition you will be asked to leave and a commercial cleaning fee will be charged and passed onto you.
  • No smoking: For everyone's comfort, we are a smoke free property. Smoking is strictly prohibited throughout the entire property. Smoking, open flames eg candles, incense or vaping are prohibited in the Cottages. Breach of this condition will result in an immediate eviction and an additional minimum $350 fee.
  • Strict safety regulations prohibit guests from bringing and using any portable cooking or heating appliances at Kiewa Country Cottages. Eg: portable stoves, BBQ's, hotplates, woks etc and any heaters. Heavy penalties will apply.
  • We are a 'guests only' property and request that no visitors be invited to the property unless by prior arrangement with management.
  • Damage, breakages, theft and losses are the guest's responsibility during their stay and as such will be charged for any damage or loss caused.
  • Storing of bicycles inside the cottage is not encouraged, however if any guest chooses to store bike(s) inside, then the lead guest must sign below stating that if any damage to walls, doors, carpet or furniture/soft furnishings occurs, they will be responsible for a cleaning and/or damage fee. NO bike maintenance OR cleaning of bicycles is to be done inside the cottage or a cleaning fee will be charged.   
  • Children must be accompanied and properly supervised at all times.
  • Please consider other guests and keep noise down between 10.00 pm and 8.00 am.
  • Management is not responsible for personal belongings and valuables left anywhere on the property.
  • We reserve the right to allocate cottages where management deems appropriate. Requests for certain cottages will try to be accommodated but not guaranteed.
  • Management (Andy or Jenny Laidlaw) reserve the right to enter a cottage (when unoccupied) for repairs/maintenance and/or to turn off heaters/lights.
  • Parties and other entertaining: We have a zero policy on parties/functions/Hen's or Stag parties being held on the Premises. 
  • A party being defined as:
  • Any situation where the maximum number of guests allowed per cottage is exceeded or
  • Any situation where the noise level from the cottage is deemed too high thereby disturbing other guests and/or residents or
  • Any situation where it is deemed that intoxication is occurring or excessive alcohol is present 
  • If any Cottage(s) are identified as having a party or function we reserve the right to immediately request all occupants of the cottage(s) to vacate the Premises and terminate the stay. In such a situation, the Total Booking Fee will be forfeited. In addition any expense resulting from additional cleaning, replacement of any furniture/fixture/breakages, as well as any repairs will be charged to your credit card. If any Cottage(s) are identified as having a party or function we reserve the right to immediately request all occupants of the Cottage(s)to vacate the Premises and terminate the stay. If there is any loss of income due to the property being under repair, you will also be responsible for these charges until such a time that the cottage(s) is available to be re let.


 These terms and conditions and Policies will be strictly enforced! Guests who breach our conditions will have their details registered on the 'Guests Behaving Badly' national database!



Definitions:

  • “Booking” means the period for which you have paid to stay at the property.
  • “Property” means Kiewa Country Cottages and all its fixtures, fittings and equipment.
  • “Management” means the owners and managers of the property.
  • "Guests" means the persons who stay on the property during the booking.

 



Privacy Information

 

  • You consent and authorise Kiewa Country Cottages to collect, use and disclose your personal information for the purposes of administering your booking and providing you with any services associated with your booking.
  • Kiewa Country Cottages will not provide or disclose any information you have provided to Kiewa Country Cottages to any person without your prior written consent, except to the extent required to administer your booking and providing you with any services associated with your booking.

 


 

Indemnity and Limitation of Liability

 

  • To the extent permitted by the law, you agree to release, indemnify and hold harmless, Kiewa Country Cottages and its current and former officers, employees, contractors, sub-contractors/consultants (including their respective employees and contractors) and agents against, from and in respect of all expenses, costs, liabilities, claims, actions, proceedings, damages, judgments and losses of any kind whatsoever (including but not limited to consequential and economic losses, property loss/damage and damages for injury, including personal injury and death) arising out of, caused by, attributable to or resulting from your booking or your stay at the property except to the extent such expense, cost, liability, claim, action, proceeding, damage, judgment or loss arose out of, was caused by, attributable to or resulted from Kiewa Country Cottages' negligence, wrongful act/omission or breach of these terms and conditions.
  • To the extent permitted by law the aggregate of Kiewa Country Cottages ' liability to you is limited to an amount not exceeding the amount paid by you for your booking.
  • Each indemnity in these terms and conditions is a continuing and independent obligation and survives the termination or expiry of these terms and conditions.

 


 

Australian Consumer Law

 

  • To the extent permitted by law, all conditions, warranties, guarantees, rights, remedies, liabilities and other terms implied or conferred by statute, custom or the general law that impose any liability or obligation on Kiewa Country Cottages are excluded under these terms and conditions.
  • Nothing contained in these terms and conditions excludes, restricts or modifies the application of any provision, the exercise of any right or remedy, or the imposition of any liability under the Australian Consumer Law or under any international consumer protection legislation, provided that, to the extent that such law permits Kiewa Country Cottages to limit its liability, then Kiewa Country Cottages' liability is limited to:
  • in the case of services, supplying the services again or payment of the cost of having the services supplied again; and
  • in the case of goods, replacing the goods, supplying equivalent goods or repairing the goods, or payment of the cost of replacing the goods, supplying equivalent goods or having the goods repaired.
